Terms of service

The agreement

These terms are an agreement between you and Avalone Co. (“we”, “us”) for the mobile game Mutation Nursery (“the game”). By downloading or playing the game you accept them. If you don’t agree, please don’t play. The game is meant for players aged 13 and over; if you are under the age of majority where you live, please read these terms with a parent or guardian.

Google Play’s own terms also apply to your download and your purchases. Our privacy policy explains how information is handled.

Your licence to play

We give you a personal, non-exclusive, non-transferable, revocable licence to install and play the game on Android devices you own or control, for your own non-commercial entertainment. You may not sell, rent or sublicense the game, or use it to make money (for example by selling accounts, saves or items), except as the law expressly allows.

Coins, gems and other virtual items

• Coins, gems, boosts, Lucky Seeds and other in-game items are part of the game. You get a licence to use them in the game; you don’t own them.
• They have no real-world value, can’t be exchanged for money or anything outside the game, and can’t be transferred to other people or other games.
• We may rebalance prices, rewards and odds to keep the game fair and fun. The chances of mutations are shown in the game.

Purchases and refunds

You can buy optional items in the game, such as gem packs, a starter pack, Remove Ads, Night Watchman and VIP Greenhouse. All purchases are processed by Google Play, at the price shown in the store before you confirm, including any taxes Google applies.

• Refunds are handled by Google Play under its refund policy. You can request one in the Play Store app or at play.google.com under your order history. If you have trouble, email us with your order number and we’ll help.
• One-time purchases (Remove Ads, Starter Pack, Night Watchman, VIP Greenhouse) stay linked to your Google account. Use Restore Purchases in the game’s Shop after reinstalling or on a new phone.
• Gems you buy are added once and are used up when you spend them.
• Nothing in these terms limits any rights you have under consumer protection laws that apply to you.

Ads

The game shows ads from Google AdMob. Rewarded ads are always optional; you choose to watch them for a reward, and the reward is given once the ad finishes. Short in-between ads may appear during play; the Remove Ads purchase turns them off. Ad content is limited to material suitable for general audiences. We are not responsible for the content of third-party ads or the products they advertise, but please tell us if you see an ad that seems inappropriate.

Fair play

Please don’t:

• use cheats, bots, modified versions of the game, or tools that change its data, time or purchases;
• copy, decompile or reverse-engineer the game, except where the law permits it despite this restriction;
• try to get purchased items without paying, or abuse bugs to do so;
• use the game in a way that breaks the law or infringes anyone’s rights.

Your progress

The game saves your progress on your phone; there is no online account. Uninstalling the game or clearing its storage deletes that progress unless Android backup has a copy. We can’t restore progress that was lost from your device, because we never have a copy of it. One-time purchases can always be restored from Google Play.

Who owns what

The game, including its code, art, music, sounds, characters, names and the Avalone Co. and Mutation Nursery names and logos, belongs to Avalone Co. or its licensors and is protected by copyright and other laws. Some free-to-use third-party assets are included under their own licences. These terms don’t give you any rights to them beyond playing the game. You’re welcome to share screenshots and videos of your nursery for non-commercial purposes.

Changes to the game

We update the game from time to time to fix problems, add content or change features. Some updates may be required to keep playing. We may also, with reasonable notice where possible, stop offering the game. If we do, one-time purchases you made will stay usable for as long as the installed game keeps working on your phone.

Our responsibility

We work hard to make the game fun and reliable, but it is provided “as is” and “as available”: we can’t promise it will always be free of bugs or interruptions. To the extent the law allows, Avalone Co. is not liable for indirect or consequential losses, or for loss of in-game progress or items. Where the law does not allow us to exclude liability, our total liability to you is limited to the amount you paid for in-game purchases in the twelve months before the claim. None of this limits liability that cannot be limited by law.

Changes to these terms

If we change these terms, we’ll update this page and the date at the top. For important changes we’ll also let you know in the game or in the store listing notes. Continuing to play after a change means you accept the new terms.
